These Terms and Conditions apply to all services provided by Lawn Squad Pty Ltd (ABN: 38 676 234 512), herein referred to as “Lawn Squad”, to its clients.

1. Definitions

• “Client” refers to any person or entity engaging Lawn Squad for services.
• “Services” means all gardening, lawn care, landscaping, maintenance, and related services provided by Lawn Squad.
• “Agreement” refers to these Terms and Conditions and any written quotation or job agreement provided.

2. Quotes and Pricing

• All quotes provided by Lawn Squad are valid for 30 days unless otherwise stated.
• Prices may be subject to change based on unforeseen site conditions or if additional services are required.
• Any variation to the agreed scope must be approved in writing by both parties and may incur additional charges.

3. Invoicing and Payment

• Invoices are issued upon completion of services, unless otherwise agreed.
• Payment terms are ‘due upon receipt’ meaning the same day the invoice is issued.
• Late payments may attract a late fee of 5% per month on the outstanding balance.
• Lawn Squad reserves the right to suspend or cancel future services for overdue accounts.

4. Cancellations and Rescheduling

• Clients must provide at least 24 hours’ notice to cancel or reschedule a booking.
• Late cancellations may incur a cancellation fee of up to 50% of the scheduled service fee.
• In case/s of extreme weather or unsafe conditions, Lawn Squad may reschedule work at its discretion, with no penalty to the client.

5. Access and Site Conditions

• Clients must ensure safe and unobstructed access to the property and work areas on the scheduled service day.
• Lawn Squad will not be responsible for delays or incomplete work due to:
  • Locked gates or restricted access
  • Aggressive pets
  • Unsafe working conditions

6. Safety and Compliance

• Lawn Squad complies with all relevant Work Health and Safety (WHS) legislation and standards.
• Clients agree to maintain a safe working environment for Lawn Squad staff and to notify us of any known hazards.
• Lawn Squad reserves the right to cease work if conditions are deemed unsafe.

7. Damage and Liability

• While every care is taken, Lawn Squad is not liable for damage to underground pipes, cables, irrigation systems, or other concealed infrastructure unless clearly identified in writing by the client prior to work.
• Lawn Squad holds public liability insurance, and any accidental damage caused by our team will be handled in accordance with our insurance process.

8. Garden Waste and Rubbish Removal

• Standard pricing includes minor green waste removal (e.g., lawn clippings, small trimmings).
• Large volumes of waste, hard rubbish, or landfill material may attract additional disposal fees, which will be communicated in advance.

9. Ongoing Maintenance Agreements

• For clients on scheduled maintenance plans, services will be carried out at agreed intervals.
• Pricing may be adjusted periodically to reflect changes in service frequency, fuel costs, inflation, or scope.

10. Client Property and Equipment

• Lawn Squad staff will not use client-supplied tools or machinery unless agreed in writing.
• Lawn Squad is not liable for damage to or caused by client-owned equipment.

11. Termination of Services

• Either party may terminate ongoing services by providing 14 days’ written notice.
• Outstanding payments must be settled prior to or upon final service.

12. Intellectual Property

• All designs, plans, or documentation created by Lawn Squad remain the intellectual property of Lawn Squad, unless agreed otherwise in writing.

13. Force Majeure

• Lawn Squad is not liable for delays or non-performance due to circumstances beyond its control (e.g., extreme weather, natural disasters, pandemics).

14. Governing Law

• These Terms are governed by the laws of the State of Tasmania, Australia.
• Any disputes shall be resolved in accordance with the jurisdiction of the courts of that state.

15. Acceptance of Terms

By engaging Lawn Squad, the client acknowledges they have read, understood, and agree to be bound by these Terms and Conditions.
